Failing CI on 3.10

Hey @Valentin-v-Todorov,
The Python 3.10 is failing because of some filesystem handling issues (difference between newer versions and older ones).
The test runs successfully on newer versions but fails on the older ones. I suggest using pytest mark this test to skip when version of Python is 3.10. Let me know what do you think and everyone else thinks?
