fn:collection non-node collection restricted to xquery, not xpath

in fn:collection, cbcl-collection-002", cbcl-collection-003, cbcl-collection-004, are all gated to xquery, not xpath.

But shouldn't xpath in principle also be able to support non-node collections?

Perhaps the dependency is there because the collections are defined using <collection><query>...</query></collection>, and the <query> element is defined to take an XQuery expression rather than an XPath expression.

Oh that makes sense then, though it's not really used in these tests it might be used that way elsewhere. I saw a few other tests in this module that I thought modern xpath shoudl be able to handle.
